The Delhi High Court has granted a couple the right to use the frozen sperm of their deceased son, Preet Inder Singh, for surrogacy. After a four-year legal struggle, the couple can now proceed with surrogacy to continue their son’s legacy.
Preet, diagnosed with Non-Hodgkin’s Lymphoma in June 2020, stored his sperm before undergoing chemotherapy. After his passing in September 2020, his parents, Harbir Kaur and Gurvinder Singh, sought to use the sperm, but the hospital refused, prompting them to take legal action.
Justice Prathiba Singh ruled that Indian law allows posthumous reproduction if consent is given, and under the Hindu Succession Act, Preet’s parents, as legal heirs, were entitled to access his sperm.
The family plans to keep the surrogacy within the family, with a relative serving as the surrogate.
