In a recent court ruling, a motion on notice was filed by Nwabueze Ugwu, prompting the court to declare Senator Anyanwu’s position as National Secretary of the PDP vacant.
Presiding Judge, Justice C.O Ajah, issued an order directing the defendants in the case, which included the PDP National Chairman, the PDP National Secretary, and the National Vice Chairman for the South-East, to officially recognize Sunday Udeh-Okoye as the candidate nominated by the South-East Zonal Executive Committee. This recognition was to stand pending the determination of the motion on notice.
Justice Ajah made this ruling based on the motion filed under order 38 rule 1 and order 39 rule 1 of the High Court rules of Enugu State 2020. The motion was supported by a 23-paragraph affidavit submitted by the applicant.
The key directives from the court order are as follows:
1. An interim order is granted as requested.
2. The second Defendant/Respondent (PDP National Secretary) must recognize HON. S.K.E. UDEH-OKOYE, recommended by the South East Zonal Executive Committee of the PDP, within 24 hours of the service of this order.
3. This order will expire seven days from the date of issuance in accordance with court rules.
4. The matter is adjourned for the hearing of the Motion on Notice to take place on 30/10/2023.
The decision to replace Anyanwu with Udeh-Okoye was previously announced by the South East Zonal Executive Committee of the PDP in a communique dated October 20, 2023. The decision was reached unanimously during a meeting attended by members from across the geopolitical zone, who believed that Anyanwu assuming both the roles of national secretary and PDP standard-bearer in Imo would be a distraction.
